Definitions
“Company” refers to Borna Surveys.
“Client” refers to the ব্যক্তি or organisation instructing the Company.
“Services” refers to land surveying services including measured building surveys, topographical surveys, boundary surveys, volumetric surveys, 3D laser scanning, drone surveys, hydrographic surveys, and setting out.

Scope of Services
2.1 The Company will carry out the Services as agreed in writing (quotation or email confirmation).
2.2 The Company provides land surveying services only and does not undertake building condition surveys, structural assessments, or RICS Level 2/3 reports.
2.3 Any additional work requested outside the agreed scope may be subject to additional fees.

Fees & Payment Terms
3.1 Fees are as stated in the quotation and are exclusive of VAT unless otherwise stated.
3.2 A minimum 50% deposit is required prior to attending site.
3.3 The remaining balance is payable upon delivery of drawings or within 7 days of invoice, whichever is sooner.
3.4 The Company reserves the right to withhold drawings and deliverables until full payment is received.
3.5 Late payments may be subject to statutory interest and recovery costs in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

Site Access & Client Responsibilities
4.1 The Client must ensure safe and adequate access to the site at the agreed time.
4.2 The Client is responsible for obtaining any necessary permissions from third parties.
4.3 Any delays caused by restricted access or site conditions may result in additional charges.

Programme & Delivery
5.1 Survey dates are subject to availability and confirmed upon receipt of deposit.
5.2 Delivery timeframes are estimates and may vary depending on project complexity.
5.3 The Company will use reasonable endeavours to meet agreed deadlines but shall not be liable for delays beyond its control.

Accuracy & Limitations
6.1 Surveys are carried out using industry-standard equipment and methods.
6.2 Drawings represent visible and accessible features at the time of survey.
6.3 The Company shall not be liable for hidden defects, underground services (unless specifically agreed), or changes made after the survey date.

Use of Drawings
7.1 All drawings and data are produced for the specific project stated.
7.2 The Company accepts no liability for use of the drawings for any other purpose without prior written consent.
7.3 Copyright of all drawings and survey data remains with the Company until full payment is received.

Health & Safety
8.1 The Company operates in accordance with relevant health and safety regulations.
8.2 The Company reserves the right to suspend works if site conditions are deemed unsafe.

Cancellation & Rescheduling
9.1 Cancellations made less than 48 hours before the scheduled survey may incur a charge.
9.2 The Company reserves the right to reschedule due to weather, access issues, or unforeseen circumstances.

Liability
10.1 The Company’s liability is limited to the value of the fee paid for the Services.
10.2 The Company shall not be liable for any indirect or consequential losses.

Complaints
11.1 Any concerns should be raised in writing within 7 days of delivery.
11.2 The Company will endeavour to resolve any issues promptly.

Governing Law
12.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales.
